These Terms of Service govern your use of kelvinandco.store and any purchase you make from it. The store is operated by Kelvin & Co. ("we", "us", "our"). By using the site or placing an order, you agree to these terms. If you do not agree with them, please do not use the site.

Who can buy

You must be at least 18 years old, or the age of majority where you live, to place an order. We currently ship to addresses in the United States only. Orders with a shipping address outside the United States cannot be accepted.

Products and descriptions

We describe every lamp as accurately as we can, including its dimensions, materials and finish. Colours can look different from one screen to another, and materials such as stained glass, marble and blown glass vary naturally from piece to piece, so no two are identical. Small variations of this kind are a feature of the material rather than a defect.

We may change or discontinue any product at any time.

Prices and payment

All prices are in US dollars and do not include sales tax, which is calculated at checkout where it applies. Prices can change at any time, but a change will never affect an order you have already placed.

Payment is taken when you place your order. You confirm that you are authorised to use the payment method you enter.

Errors

Occasionally a price or a product detail on the site may be wrong. If we discover an error affecting an order you have placed, we will contact you before doing anything else, and you can either confirm the order at the corrected price or cancel it for a full refund. We will never charge you a higher price than the one you agreed to without asking you first.

Accepting your order

Your order is an offer to buy. A confirmation email is an acknowledgement that we have received it, not acceptance. The contract is formed when we ship. We may decline or cancel an order, and refund you in full, if the item is unavailable, if there was a pricing error, if we cannot verify the payment or the address, or if we reasonably suspect fraud or resale.

We may limit the quantity of any item bought in a single order.

Shipping and returns

Delivery times, costs and what happens if an order is delayed are set out in our Shipping Policy. Returns, refunds, cancellations and warranty claims are set out in our Refund Policy. Both form part of these terms.

Using your lamp safely

Our lamps are electrical products rated for US household current at 110V to 120V. They are for indoor domestic use only. Please:

follow the instructions supplied with the lamp
use a bulb of the type and maximum wattage stated on the product page, where the lamp takes a replaceable bulb
keep the lamp away from water, curtains, bedding and anything else that can catch fire
switch it off and unplug it before changing a bulb or cleaning it
stop using it and contact us if the cord, plug or housing is damaged

Several of our lamps are made of glass and are breakable. Place them where they will not be knocked over, and supervise young children and pets around them. Do not modify a lamp, rewire it, or use it with a voltage converter or a bulb outside the stated rating. Doing so is unsafe and ends the warranty.

Warranty

Each lamp carries a 1-year limited warranty against manufacturing defects, starting on the day it is delivered. If a lamp fails through normal domestic use within that year, we will repair it, replace it, or refund you, at our option.

The warranty does not cover accidental damage, misuse, unauthorised repair or modification, normal wear, bulbs you supplied yourself, or damage caused by using the lamp outside its stated rating. Beyond this warranty and any rights you have under the law where you live, products are supplied as they are.

The website

The content of this site, including text, photography, graphics and the Kelvin & Co. name and logo, belongs to us or to our licensors. You may browse it and share links to it. You may not copy, republish or use it commercially without our written permission.

You agree not to use the site to break the law, to interfere with how it runs, to scrape it at scale, or to attempt to gain access to any part of it you are not meant to reach.

We try to keep the site available and accurate, but we do not promise it will be uninterrupted or error free.

Limits on our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Some states do not allow certain limitations, so parts of this section may not apply to you.

Subject to that, our total liability to you in connection with an order is limited to the amount you paid for it. We are not liable for indirect or consequential loss, such as lost profit or lost opportunity.

Privacy

Our Privacy Policy explains what personal information we collect and what we do with it.

Changes to these terms

We may update these terms. The version published on this page when you place an order is the version that applies to that order.

Governing law

These terms are governed by the laws of the United Arab Emirates, where our business is established. This does not remove any protection you have under the mandatory consumer law of the US state where you live, and it does not prevent you from bringing a claim in your local courts where the law gives you that right.
